A Madison County grand jury will hear capitol murder charges against three teens accused of killing a six-year old boy.
May 18th, 6-year old Kingston Frazier was sleeping in his mother's car when it was stolen from a Jackson grocery store. Later he was found shot to death in Madison County. Nineteen-year old Byron McBride, D' Allen Washinton and Dwan Wakefield both 17, are charged with stealing the car and killing the child. All face capitol murder. Yesterday, a Mississippi Bureau of Investigations officer testified during a probable cause hearing, McBride first said he wasn't involved. Then he said he took the car, but it was Washington who shot him, before admitting he killed Kingston. District Attorney Michael Guest says they're waiting for all the forensic evidence.
"Our office is going to sit down along with MBI and look at the information, look at the state of the case as it exists. Once we have all the evidence and at this point the case will go before the grand jury. Determination will be made at some point as to whether individuals all three continue to be charged with capital murder," said Guest.
Guests says it's not unusual to hear multiple versions of a crime. Wakefield's attorney Thomas Fortner says the teens were at the store to meet someone to sell a $10 bag of marijuana. He says his client Wakefield and Washington didn't follow McBride when he left with the stolen car. Instead, they went to Wendy's to meet the person buying weed. The investigator says video shows the Honda at a Wendy's and at a Shell gas station in Hinds County. Fortner says, Wakefield didn't know there was a child in the car until McBride called his client later, saying he'd run out of gas, he's going to "off the kid," and to come get him.
"My client didn't participate in killing that child and he didn't encourage anyone to kill that child. That's what I do know," said Fortner.
Warren Martin, the attorney for D'Allen Washington, contends his client wasn't with the teens when the car was stolen. He would not elaborate on the details. All three remain in jail without bond.
